Action for contribution by plaintiff-appellant, Continental Casualty Company, against defendant-respondent, Transport Indemnity
Company. The accident which gave rise to this litigation occurred on July 18, 1959, when one Ralph Rodgers, driving his own truck-tractor,
leased to Kenosha Auto Transport, became involved in a collision with three passenger automobiles near the intersection of
Highways 100 and 41 in Milwaukee county. At the time of the accident Rodgers was on a personal trip to visit his sister in
Milwaukee. No trailer was attached to his truck-tractor and he was not in any respect operating within the scope of his employment
with Kenosha Auto Transport Corporation. The liability of Rodgers is conceded by Transport Indemnity Company as is the reasonableness
of the settlement with claimants by Continental.
